After capturing the suspect in the murder of a married Ohio father of three, police managed to let their alleged killer slip out of their grip — out of custody, specifically.

Back in September 2023, Cuyahoga County investigators say 39-year-old Derek Driskill was riding in his new Mercedes Benz in the parking lot of a takeout spot near Cleveland when someone rammed their car into the back of it. Police said while the driver of the other vehicle was cooperative with Driskill, the passenger beside them started an argument with Driskill and shot him in the head.

Authorities took in 22-year-old Amarion Sanders as their murder suspect. However, seemingly at random, he was released Monday evening. No, it wasn’t intentional but apparently due to a pesky typo, court officials said.

When a worker with the court entered the information about the dismissal into their system, they mistakenly entered Sanders’ case number.

Sanders’s case number is CR-23-685908. The other defendant’s case number is CR-23-685909. The information was then sent to the jail’s records department. Sanders was released around 6:30 p.m. Monday night, according to jail officials.

The court’s statement also said, “Had the cases been on different dockets, the system would have flagged the error when it was entered.” Interim Chief of Corrections Nestor Rivera said the court and the Cuyahoga County Prosecutor’s Office notified them about the error at approximately 10 a.m. Tuesday morning.

After 39 hours of freedom, Sanders was captured again by officers with the Northern Ohio Violent Fugitive Task Force Wednesday morning and taken back into custody. The Court said in a release following the incident they’d review their procedures with the Sheriff’s Department to prevent this from happening again.
